Poland should guarantee access to safe, legal abortion, says human rights commissioner – POLITICO

The Council of Europe’s Commissioner for Human Rights on Wednesday called on Poland to restore access to abortion by fulfilling its international and European legal obligations.

In October 2020, Poland’s Constitutional Tribunal ruled women can terminate their pregnancies only in cases of rape or incest, or if their life is in danger.

In written observations to the European Court of Human Rights, the commissioner, Dunja Mijatović, said the ban “represents the latest step in an already overwhelmingly prohibitive legal and procedural framework governing access to safe and legal abortion care, with a harmful impact on women’s human rights in Poland.”

EU member states not only have the obligation to make safe abortion care legal, the commissioner stressed, but they must also respect and guarantee women’s effective access to abortion care.

The European Parliament is on Thursday set to approve a resolution condemning Poland’s near-total ban on abortion. Backed by a wide coalition of political groups, including the center-right European People’s Party, the resolution is almost guaranteed to succeed.
